Understanding paid leave

Maryland provides paid medical leave (PML) and paid family leave (PFL) income replacement benefits for eligible workers who need time off from work for qualifying reasons. The program is referred to as Maryland Family and Medical Leave Insurance (FAMLI).

Coverage options

State plan: Provides a baseline of benefits that all covered employers must offer.

State-approved private plans: Option to offer an approved private plan that meets or exceeds state benefits.

Employer coverage

All employers employing at least one individual in the state of Maryland are covered, excluding the federal government and also self-employed individuals who have not elected to participate in the program.

Employee eligibility

  • An employee must have worked a minimum of 680 hours in the state in the 12-month period prior to the date leave begins.
  • Self-employed people may opt into the program.

Leave reasons

PML: Employee's own serious health condition.

PFL: Caring for a family member, bonding, qualifying exigency and caring for a service member.

Job protection

Requires continuation of health insurance benefits, and with limited exceptions, reinstatement to equivalent position.

PFML benefits

Benefit percentage: Employees receive up to 90% of their average weekly wage on a sliding scale.

Maximum weekly benefit: 2026 maximum weekly benefit = $1,000.

Waiting period: No waiting period.

Maximum duration:

  • 12 weeks of paid leave per benefit year.
  • Eligible for an additional 12 weeks if employee's own serious health condition and bonding occur in the same application year.

Cost

  • The Secretary of Labor will set the total rate of contribution including employee-level contributions.
  • Employers employing fewer than 15 employees aren't required to pay the employer contribution.
  • Fewer than 15 employees: The rate will be 0.45% of covered wages up to the Social Security cap. Employers may withhold up to this full amount from the employees’ pay.
  • 15 or more employees: The rate will be 0.90% of covered wages up to the Social Security cap. Employers may withhold up to half (0.45%) of the contribution rate from the employees’ pay.

Program timeline

Contributions begin: July 1, 2025

Benefits become available: July 1, 2026
