Understanding paid leave

New Hampshire provides participating workers with paid medical leave (PML) and paid family leave (PFL) income replacement benefits for eligible workers who need time off from work for qualifying reasons. This state program is called the New Hampshire Paid Family and Medical Leave Plan (NH PFML).

New Hampshire PFML: Coverage and cost

Coverage options

State plan: Provides a baseline of benefits for state government employees. Private employers and employees can opt into the state-sponsored plan. The state plan is also available to employers as a group plan and to workers as an individual plan if their employer does not provide NH PFML insurance or equivalent benefits.

Employer coverage

New Hampshire state government employers: Provide PFML coverage to their employees.

All other employers (private and non-state public employers): May voluntarily participate in PFML. Employers must have a physical location in NH to be eligible to participate.

Employee eligibility

State government employees: All state government employees are eligible.

All other NH employees: NH employees working for an employer that does not provide coverage may purchase individual coverage. There is a one-time 7-month waiting period. There is also a one work week unpaid elimination period that must be met.

Leave reasons

State government employees: Caring for a family member, bonding, qualifying exigency and caring for a service member.

Voluntary coverage: Leave reasons include the leave noted above but also includes medical leave if their employer does not offer short term disability insurance.

Job protection

Does not provide job protection.

PFML benefits

Pay during leave: 60% of the employee's average weekly wage is capped at the Social Security wage base.

Waiting period:

  • State plan: 7 days.
  • Individual plans: There is a one-time 7-month waiting period. There is also a one work week unpaid elimination period that must be met.

Maximum duration:

  • State plan: Provides up to six weeks per year for specified leaves of absence from the workplace.
  • Employer-sponsored plans: 6 weeks of wage replacement per benefit year with an option of 12 weeks per year.
  • Individuals that purchase their own coverage: 6 weeks per year.

Cost

Employee:

  • State employees: No cost.
  • Individuals who opt in to private plan: No more than $5 per week.

Employer:

  • State employers: Pay full contribution.
  • Participating NH employers: May elect to pay all or part of employee contribution.
