Understanding paid leave

New Jersey provides paid medical leave (PML) and paid family leave (PFL) income replacement benefits for eligible workers who need time off from work for qualifying reasons. This state program is called the Temporary Disability Insurance (TDI) and Family Leave Insurance (FLI).

Coverage options

State plan: Provides a baseline of benefits that all covered employers must offer.

State-approved private plans: Option to offer an approved private plan that meets or exceeds state benefits or self-funded private plan.

Employer coverage

Employers must participate in the state public insurance programs (TDI and FLI) and deduct payroll taxes for employees working in NJ with the following exceptions:

  • Local government entities (e.g. counties, municipalities and school districts) have the option to participate in TDI.
  • Federal government employers are exempt from both TDI and FLI programs.

Employee eligibility

Worked 20 weeks in New Jersey earning at least $303 weekly or have earned a combined total of $15,200 in the base year.

Leave reasons

PML (TDI): Employee's own serious health condition.

PFL (FLI): Caring for a family member, bonding and safe leave.

Job protection

NJ PML and PFL aren’t job protected.

PFML benefits

Benefit percentage: 85% of average weekly wage on a sliding scale.

Maximum weekly benefit: $1,081.

Waiting period:

  • PML: 7-day waiting period, retroactive to the first day after 22 consecutive days of disability.
  • PFL: No waiting period.

Maximum duration:

  • PML: 26 weeks maximum but capped at one-third base year wages. 
  • PFL: 12 weeks maximum but capped at one-third base year wages.

Cost

PML:
  • Employer: Rate varies from 0.1% to 0.75% $43,300 wage cap.
  • Employee: 0.23%.
PFL:
  • Employer: None.
  • Employee: 0.33% of taxable wage base (100% employee-funded).
  • Taxable wage base: $165,400.

Employer funds the additional cost of the private plan above the employee maximums. The employer can pay all or part of the employee contribution.
